 Consumers Registration – necessary documents and procedures for the registration

 

The list of necessary documents and procedures for the registration of consumers is given in the article #4 of the regulation about “The Water Supply And Consumption Rules” approved by the resolution of the Georgian National Energy And Water Supply Regulatory Commission (November 26, 2008). The article defines the following:

1. The supplier is responsible to register all consumers who uses his service (or will use) during utilization of drinking water.

2. The consumer is obliged to use water only for the reasons indicated in the announcement.

3. The person who wants to receive and use drinking water must address the relevant supplier with the application for registration.

4. In cases of the change of the place of residence, enterprise or some different object, the new owner is liable to present the application according to this article to the relevant supplier together with the documents of the property confirmation.

5. The person who temporarily owns real estate has the right to express wish for registration and the supplier is obliged to register him/her on the present address upon receipt of the written consent from the owner of this property. Together with this, the supplier has the right to request the transfer of money on the own deposit and to request the total payment of the existing liability from this person according to the conditions defined by these rules (it is possible to request the total payment of the existing liability, if the registration of this temporary user results in abolishment of the registration of the consumer who had the previous liability. Accordingly, in case of non-payment of the liability or disagreement on the conditions of payment, the supplier has the right to refuse the registration of the consumer on the relevant address).

6. The applicant, with the statement about registration, announces his/her right to receive and consume water according to the conditions of these rules and the legislation. On the other hand, the supplier, with registration of the applicant, expresses the consent and takes responsibility to supply the applicant (consumer) with water according to the conditions of these rules and the legislation. The supplier and the consumer have the right to request the written confirmation of this agreement from the second side at any stage of legislative relationship.

7. The applicant cannot be asked to pay any kind of payment for implementation of necessary procedures and measurements for water supply (unless there is no condition of these rules requesting the opposite).

8. The statement should include the following:

a) Full name and address of the applicant;

b) The name of the supplier;

c) The consent of the juridical person who is responsible for the payment, his full name, address, personal identification number (other ID cards recognized by the Legislation of Georgia are acceptable), or name of juridical person, individual entrepreneur (also entrepreneur of different form), name of the institution, physical address, bank account number, identification number of the tax authority and date.

d) Place (address) for the water supply and other service;

e) Possession of real estate for the service;

f) The target of consumption of drinking water (domestic or nondomestic);

g) In case of the request from the consumer:

a) About execution of the agreement of water supply;

b) About presence of the new consumer during formation of the act of the commencement of water supply service;

c) Other requirements according to the decision of the applicant.

9. The statement must enclose the following:

a) Confirmation reference of possession of real estate. In case of the temporary usage of this estate, the written consent of the owner of real estate.

b) The written consent of the physical person who is responsible for the payment, if the applicant and the responsible person for the payment are different persons.

10. After the receipt of the statement about registration the supplier is obliged (in 5 working days) to register the user and provide the water supply service according to the conditions of these rules (if the technical conditions are followed).
